ADJUSTERS
Alaska's Insurance Department issued a bulletin informing carriers it is accepting independent adjuster license exemption applications due to the Disaster Declaration as a result of severe winter storms, extreme winds and cold temperatures. The license criteria that must be met is provided in the bulletin. Bulletin B22-01
AUTOMOBILE INSURANCE
Colorado amended its regulation concerning automobile insurance consumer protections. Among other things, "Usage-based insurance" as a rating structure is re-defined. Regulation 5-2-12, 3 CCR 702-5
Michigan's Department of Insurance reports that the Michigan Catastrophic Claims Association Board voted to return approximately $3B of surplus to member insurance companies. Insurers are expected to issue refunds to policyholders of policies in force as of October 31, 2021. The refunds must be completed no later than May 9, 2022. Bulletin 2021-44-INS
Oregon's Department of Consumer and Business Services issued a bulletin concerning the expected 2021 auto rates and filings for private passenger auto insurance considering the changes to consumer driving patterns as a result of the COVID-19 pandemic. Updated rates and information provided in response to the questions found in the bulletin are required to be submitted by April 1, 2022. Bulletin DFR 2021-6
CREDIT FOR REINSURANCE
Colorado amended its Credit for Reinsurance regulation to bring it in line with revisions to the NAIC Credit for Reinsurance Model Regulation. Amended Regulation 3-3-3; 3 CCR 702-3
The Texas Department of Insurance adopted new regulations for credit for reinsurance. The changes eliminate collateral and physical presence requirements for certain insurers that regulate aspects of reserve financing. 28 TAC 7.614 - 7.616
DISASTER / CATASTROPHIC EVENT
Alaska's Insurance Division issued a bulletin asking carriers of all lines of insurance to provide fair treatment to consumers following severe weather. The Governor declared a disaster in Alaska due to severe winter storms, winds, and extreme cold temperatures in certain geographic areas. Carriers are directed to provide extension of premium grace periods of at least two weeks, conduct a reasonable investigation of all available information, and act promptly on communications with consumers. Colorado adopted an emergency regulation to protect homeowner policyholders who suffered a loss during a catastrophic disaster such as the recent wildfires. The regulation identifies specific acts or practices that may constitute unfair claim practices by insurers in regard to additional living expense coverage, delay in claim settlement for a catastrophic disaster, and recoverable depreciation. MISCELLANEOUS
Idaho's Insurance Department issued a bulletin about the Terrorism Risk Reinsurance Program Reauthorization Act of 2019 which extended the Terrorism Risk Insurance Act of 2002. The Act has been extended through 2027 by Congress. The law and its impact on commercial carriers is explained in detail. Some carriers must submit rates, policy form language and disclosure notices. POLICY LANGUAGE
Oklahoma's Insurance Department issued a bulletin to all Property & Casualty Carriers. The Department directs that any policy language that reduces or restricts coverage due to a triggering event during the policy term must be printed in all CAPS and in bold or red font, so as to be clearly visible to a policyholder. PROPERTY INSURANCE
Michigan's Department of Insurance released its periodic update of municipalities taking part in the Fire Insurance Withholding Program. Municipalities Participating in the Fire Insurance Withholding Program - Edition 139
Virginia revised the rule that establishes minimum standards for the contents of dwelling property and homeowners’ insurance policies. 14 VAC 5-340-10
REINSURANCE
New Jersey released its list of qualified "Certified Reinsurers." All insurers domiciled, licensed or eligible to write surplus lines insurance are allowed to take full credit for reinsurance ceded to the listed reinsurers under specified circumstances. Notice dated January 1, 2022

Florida's Insurance Commissioner reminds insurers that SB 76 contains new claims litigation data reporting requirements for personal and commercial residential property insurers. Informational Memorandum OIR-22-01M
TITLE INSURANCE / AGENTS
The Texas Insurance Commissioner issued a mandatory data call to title insurance underwriting companies doing business in Texas. The required information must be reported by February 28, 2022. Bulletin B--0031-21
TRAVEL INSURANCE
Wisconsin passed the NAIC Model Travel Insurance Act. Travel insurance is currently regulated by authorizing a limited lines travel insurance producer's license and allowing travel retailers to offer travel insurance under a limited lines travel insurance firm license. This bill maintains these requirements and allows TPAs, Managing General Agents and others to apply for a limited lines producer license. SB 482
WORKERS' COMPENSATION
Alaska's Workers' Compensation Division announced updated allowances for transportation, meals and lodging while traveling for medical treatment. Bulletin WC 22-01
Connecticut's Governor announces a 2022 rate decrease for workers' compensation insurance for the 8th straight year. Notice dated January 12, 2022
Michigan amended its workers' disability compensation general rules. Rule 408.31
Michigan announced updated travel reimbursement rates for injured employees including mileage, meals, and lodging. Travel Reimbursement Rates dated 1-1-2022
Ohio's Bureau of Workers' Compensation amended rules regulating professional employer organizations (PEOs). Rule 4123-17-15
South Carolina announces that it approved the NCCI's most recent loss cost filing. It has an approval date of December 15, 2021, with an effective date of February 1, 2022. Insurers must make a filing to adopt the new loss costs within 60 days after the approval date. CAPTIVES
Connecticut's Insurance Department issued a bulletin regarding financial reporting requirements for captive insurers. This pertains to captive insurers domiciled in Connecticut as well as captives not domiciled in Connecticut but doing business there. It also applies to Risk Retention Groups formed as captives. CREDIT FOR REINSURANCE
Colorado amended the Credit for Reinsurance Regulation to bring Colorado law into alignment with revisions to the NAIC Credit for Reinsurance Model Regulation (Model Regulation 786). Regulation 3-3-3

Indiana's Insurance Department announced revised credit life and credit accident and health insurance rates based on the state's triennial review. Bulletin 262
DISASTER / CATASTROPHIC EVENT
Wisconsin's Commissioner of Insurance informs health carriers of the credentialing of temporary licensed health care providers during the COVID health emergency. Health care providers credentialed in another state may provide care in Wisconsin if they apply for a temporary license within 30 days. Health carriers are asked to refrain from making coverage determinations based solely on the fact a health care provider is operating under a temporary license. Bulletin dated December 2, 2021

Arkansas promulgated a rule that requires a health insurer, HMO, hospital medical services corporation, self-insured governmental or church plan, or Arkansas Medicaid program that provides coverage for prescription eye drops to provide early refills under certain conditions. Rule 120
Arkansas promulgated a rule to implement the administration of coverage for use of certain off-label drug treatments to treat patients diagnosed with acute-onset neuropsychiatric syndrome and pediatric autoimmune neuropsychiatric disorders associated with streptococcal infection. Rule 127
Arkansas promulgated a rule regulating Medication Step Therapy Protocols for group health benefit plans that provide prescription drug coverage. Rule 107
FINANCIAL REGULATION
New York's Department of Financial Services adopted the NAIC Accounting Practices and Procedures Manual as of March 2021. It also added language regarding risk-based capital. 16th Amendment to 11 NYRCC 83, Regulation 172
HEALTH INSURANCE - COMPREHENSIVE
Arkansas promulgated Rule 106 establishing minimum standards for the creation and maintenance of networks by health carriers and to assure the adequacy, accessibility and quality of health care services offered under health benefit plans. This regulation complies with the federal requirement that Qualified Health Plans provide sufficiently accessible medical providers. Rule 106
Delaware's Department of Insurance issued a bulletin to health insurers regarding the Department's authority and intention to enforce certain provisions of the Federal No Surprises Act. Domestic & Foreign Insurers Bulletin No 127
The Federal Department of Health and Human Services (HHS) published Frequently Asked Questions (FAQs) regarding Notice of Consent requirements and the No Surprises Act pertaining to out-of-network providers and facilities. FAQs dated December 22, 2021
Georgia's Insurance Commissioner reminds health insurers that HB 454 goes into effect on January 1, 2022. This law requires an insurer to reimburse a provider at in-network rates for 180 days if the provider is listed as participating in the insurer's provider directory at the time a covered person elects their benefit plan, and that provider then becomes out of network subsequent to open enrollment in the succeeding plan year. Nevada's Insurance Department provides guidance to comply with NRS 679B.124. This law requires the commissioner to develop, prescribe and make available a form letter that a health carrier must use to notify a provider of health care of the denial of the application to be included in the carrier's network of providers. New Hampshire's Insurance Department issued a bulletin regarding the Federal No Surprises Act and State Balance Billing Protections. The Commissioner gives guidance relating to state and federal law differences. Bulletin INS 21-103-AB
New York's Department of Financial Services amended Regulation 62 to add Section 52.16(p). This section requires policy language prohibiting an insured from paying a copayment, coinsurance, or annual deductible for visits to a provider to diagnose COVID or laboratory tests to diagnose COVID. A carrier must provide written notice to its in-network providers that they cannot collect a copayment, deductible, or coinsurance for these services. 57th Amendment to 11 NYCRR 52, Regulation 62
Ohio's Insurance Department adopted a rule protecting insureds against surprise medical billing. The rule pertains to reimbursement for unanticipated out-of-network care. OAC 3901-8-17
Washington's Insurance Commissioner issued a memorandum to self-funded plans that opted-in to Washington's Balance Billing Protection Act with an "Auto Renewal" option. When each group renews on and after January 1, 2022, it will be protected from balance billing under both state law and the Federal No Surprises Act. The two laws will work together. Washington state law will apply first and where state law does not provide protection, the federal law will be initiated. Each group must consider whether it is more advantageous to continue to be protected by one or both laws. Memorandum dated December 7, 2021

New Jersey's Insurance Department updated the address, email, phone number and other contact information of the Insurance Claims Ombudsman for consumers seeking review of disputed claims. NJAC 11:25-1.3
MISCELLANEOUS
Arkansas adopted a rule to implement the Insurance Business Transfer Act. The rule sets standards and procedures for the transfer of insurance policies from a transferring insurer to an assuming insurer and completely transfers all risks, obligations, and liabilities to the assuming insurer. REGULATORY REPORTING REQUIREMENTS
Federal DOL, HHS and IRS issued interim final regulations implementing the requirement for group health plans (insured, self-funded, non-federal governmental plans, church plans, others) and insurers who write group and individual health insurance to report prescription drug and health care spending to the federal government. Enforcement action will not be initiated against plans or insurers that submit the required data for the 2020 and 2021 reference years by December 27, 2022. 5 CFR Part 890; 26 CFR Part 54; 29 CFR Part 2590; 45 CFR Part 149
Maryland's Insurance Commissioner adopted a new regulation regarding filing of nonquantitative treatment limitation comparative analysis reports by carriers for Mental Health Benefits and Substance Use Disorder Benefits. COMAR 31.10.51.01

Connecticut issued a bulletin to risk retention groups regarding 2021 and 2022 Financial Filing and other requirements. This applies to Risk Retention Groups doing business, registered, or domiciled in Connecticut. Bulletin FS-4RR-21

New York's Department of Financial Services promulgated a new regulation dealing with risk-based capital. 11 NYCRR 77, Regulation 220
SERVICE AND ADMINISTRATIVE FEES
Delaware's Insurance Department issued a bulletin directed to insurance carriers that issue health benefit plans in Delaware. The bulletin provides updates for assessment year 2022 and reminds applicable carriers of their obligation to pay the assessment. Domestic & Foreign Insurers Bulletin No. 113 (Reissued)
UTILIZATION REVIEW - HEALTH CARE
Kentucky issued an Advisory Opinion to all insurers with health lines of authority and all Utilization Review entities licensed in Kentucky regarding its interpretation of utilization review requirements. Licensees must notify their agents and employees of the interpretation which is effective for all new and renewed Utilization Review applications beginning January 1, 2022. Advisory Opinion 2021-05

ACTUARIAL
Washington amended a regulation to change the credentials of an actuary who can sign the Statement of Actuarial Opinion for property and casualty insurers to conform to the 2019 NAIC updated requirements. WAC 284-07-060
COMMERCIAL LINES INSURANCE
California amended the FAIR Plan of Operations to increase combined coverage limits under the Commercial Property Program and the Businessowners Program. Order 2021-4
CREDIT FOR REINSURANCE
New Hampshire readopted its reinsurance regulation with changes. This regulation allows credit for reinsurance ceded by a domestic insurer to an assuming insurer. Ins 601.01
CROP HAIL INSURANCE
Minnesota's Commissioner of Insurance updated the requirements for Crop-Hail Insurance Filings. Bulletin 2021-2
FILING REQUIREMENTS / PROCEDURES
Illinois amended its law so that travel insurance which provides coverage for sickness, accident, disability, or death occurring during travel, either exclusively, or in conjunction with related coverages of emergency evacuation or repatriation of remains, or incidental limited property and casualty benefits such as baggage or trip cancellation may be filed for purposes of rates and forms under either an accident and health line of insurance or an inland marine line of insurance. FLOOD INSURANCE / NFIP
Alabama announced its intention to foster a viable private flood insurance market since there appears to be a gap in coverage between claims filed through the National Flood Insurance Program (NFIP) and those that come from outside high-risk flood areas. Insurers are not required to file rates for flood insurance other than on motor vehicles, but forms must be filed. Neither Regulation 136 nor Bulletin 1010-10 will apply to private flood insurance. MISCELLANEOUS
Alaska changed its process regarding filing of business address changes, email, phone number, FAX, and mailing address. The Division now accepts electronic address change amendments for business entities through NIPR. If a paper change form is submitted, there is an additional $50 processing fee unless the licensee is moving to or from Alaska in which event it must be submitted on paper. Bulletin B21-07
Colorado's Division of Insurance issued a bulletin giving guidance to insurers subject to the new Hazard Mitigation Fee established by HB 21-1208, 24-33.5-1619 C.R.S. The bulletin is intended for all insurers issuing policies or contracts insuring property and risks in Colorado under Fire, Allied Lines, Private Crop, Farmers Multiple Peril, Homeowners Multiple Peril or Commercial Multiple Peril. Insurers are required to pay a fee of $2 per policy held between March 1, 2022, and December 31, 2022, no later than July 1, 2023. Bulletin B-1.36
Michigan's Insurance Department announced that the annual adjustment of the fire insurance maximum escrow withholding amount is $13,835 effective January 1 through December 31, 2022. Bulletin 2021-41-INS

Connecticut issued a bulletin addressed to accredited reinsurers regarding 2021 and 2022 financial filing requirements. Certificates of accreditation will be automatically renewed on June 1, 2022, subject to certain standards. Bulletin FS-4AR-21
Connecticut issued a bulletin addressed to domiciliary and non-domiciliary carriers outlining the timeline, forms, and general instructions for filing the 2021 annual report. There are checklists, notes and general requirements for property and casualty carriers and title companies. Bulletin FS-4-21
Connecticut issued a bulletin addressed to foreign eligible surplus lines insurers regarding 2021 and 2022 financial reporting requirements. Bulletin FS-4SL-21
Connecticut's Insurance Department issued a bulletin regarding the financial reporting requirements for Captive Insurers licensed in Connecticut. Bulletin FS-4C-21
REPORTS - DATA CALLS & OTHER REPORTS
Connecticut asked insurers and surplus lines brokers to file annual surcharges for the Healthy Homes Fund no later than April 30. Policies subject to the surcharge are certain types of personal risk insurance coverage and individual residential unit that is part of a condominium or common interest community. Louisiana’s Insurance Commissioner is requiring all property & casualty insurers, including insurers that write private and/or excess flood insurance coverage and surplus lines insurers to complete a data call for catastrophe claims relating to Hurricane Ida. The Texas Department of Insurance issued a data call for 2021 annual experience and workers' compensation deductible plans due February 11, 2022. TITLE INSURANCE / AGENTS
Washington amended the Title Agent County Declarations Rule to require title agents to submit a declaration to the Insurance Commissioner's office to identify their exact counties of operations, including expansions, and provide proof of ownership or leasing rights for the applicable tract indexes. WORKERS' COMPENSATION
California Division of Workers' Compensation adjusted the Ambulance Services section of the Official Medical Fee Schedule to conform to changes in the Medicare payment system as required by Labor Code Section 5307.1 DWC Notice 2021-119 dated December 1, 2021
Florida's Division of Workers' Compensation issued an informational bulletin to all Florida Workers' Compensation carriers, self-insured employers, and third-party administrators regarding the Maximum Compensation Rate effective January 1, 2022. Informational Bulletin dated November 30, 2021
Kentucky amends its Workers' Compensation Hospital Fees for services and supplies provided to workers' compensation patients where the employer is required to pay for hospital treatment, including nursing, medical, surgical supplies, and appliances under KRS 342.020. 803 KAR 25:091
Kentucky revised the regulation that deals with individual self-insurers for workers' compensation to add new requirements. 803 KAR 25:021
The Texas Division of Workers' Compensation released its annual change notice to the Medical Fee Guideline conversion factors based on the Medicare Economic Index (MEI). The MEI for 2022 reflects an increase of 2.1%. Medical Fee Guideline Conversion Factors dated November 19, 2021
Washington published the 2022 Hourly Rates by Risk Classification Code and Fund. WAC 296-17A

ANNUITY DISCLOSURES
Mississippi adopted the NAIC amendments to the Suitability in Annuity Transactions Model Regulation. The purpose of the regulation is to require producers to act in the best interest of the consumer when making a recommendation of an annuity. Insurers must establish a system to supervise recommendations to consumers so that the insurance need and financial objectives of consumers at the time of the transaction are appropriately addressed. Rule 19.2-18.01
Texas promulgated Annuity Suitability Disclosure forms that are substantially similar to the NAIC forms. 28 TAC 3.9722
CERTIFICATE OF AUTHORITY FILINGS
Delaware's Insurance Commissioner increased the application fee and the Authority fee for a domestic company seeking a Certificate of Authority to do business. Colorado amended a regulation requiring managed care plans to maintain an adequate network and to pay claims and appeals from a provider or health care facility in a certain manner. 3 CCR 702-4; Amended Regulation 4-2-74
New York's Department of Financial Services promulgated a new section to Insurance Regulation 62 pertaining to how payment must be made by an insurer when inaccurate network information is provided by an insurer to an insured. It also pertains to surprise billing practices. 63rd Amendment to 11 NYCRR 52, Insurance Regulation 62; Section 52.77
Virginia's Insurance Commissioner issued an Administrative Letter outlining the requirements to comply with Virginia's Arbitration Process for Balance Billing Claims. Administrative Letter 2021-04
Federal Assistant Secretary for Planning and Evaluation (ASPE), U.S. Department of Health and Human Services (HHS) released an Issue Brief regarding the "No Surprises Act." This Act, which was part of the Consolidated Appropriations Act of 2021, was signed into law on December 27, 2020. This law is effective on January 1, 2022. The Issue Brief provides an overview of the federal law and contains a section on state Surprise Billing laws. HSS Issue Brief dated November 22, 2021

CMS has published a Proposed Key Dates Table for 2022 for Qualified Health Plan (QHP) in states with Exchanges that use the federal platform. Other Tables for 2022 are also included. Proposed Key Dates Tables for Calendar Year 2022 published by CMS

HEALTH INSURANCE / HEALTH RATES
New Mexico informed every current and prospective New Mexico Fully Insured Large Group Issuer of new requirements. All issuers must include three endorsements prepared by the Superintendent of Insurance to all Evidence of Coverage documents for plans that go into effect on and after January 1, 2022. Washington promulgated a Student Health Plans Rule, R 2021-13 to implement HB 1009. This law requires Student Health Plans that provide maternity coverage to also provide similar coverage for termination of pregnancy. WAC 284-43-7210 through 7250

MEDICARE SUPPLEMENT INSURANCE
Idaho's Department of Insurance promulgated a new rule regarding Medicare Supplement changes as a result of SB 1143. This rule contains two major changes dealing with enrollment and premium rates. Rule IDAPA 18.04.10
MISCELLANEOUS
Alaska's Insurance Director notified insurers, resident and nonresident licensees of changes in licensing processes and fees. The Division will now accept electronic address change amendments for business entities through www.nipr.com or one of its authorized business partners and they will be approved within 24 - 48 hours of submission. Unless the licensee is moving to or from Alaska, there is an additional $50 paper processing fee if a paper address change is submitted. Bulletin B 21-07
MISCELLANEOUS HEALTH / ACCIDENT
IRS released proposed rules that would make permanent and automatic the 30-day extension for furnishing ACA reporting forms to individuals. IRS released the 2022 cost-of-living adjustments (COLAs) for a wide variety of tax-related limits, including limits relating to health FSAs, Qualified transportation fringe benefits, qualified small employer health reimbursement arrangements (QSEHERAs), adoption assistance, DCAPs, the small business health care tax credit, the premium tax credit and Archer MSAs. Washington has developed a standard template language to serve as a single notice of consumer rights under both the Washington Balanced Billing Protection Act (BBPA) and the federal No Surprises Act (NSA).
