CAPTIVES

Iowa adopted new Chapter 113, titled Captive Companies. The rules establish the policies and procedures for the administration of captive companies, including financial, reporting and record-keeping requirements.     191-113.1+

Iowa approved a bill revising the calculation used to determine the amount of reinsurance tax due from captive companies.     HF 2636


CLAIMS / CLAIMS ISSUES

Connecticut issued a bulletin to insurers regarding health insurance claim payment activity. The bulletin describes those factors that may be considered legitimate disputes for purposes of determining timely payment.     Bulletin HC 132

Georgia enacted legislation addressing the requirement to furnish claims experience, upon request, to group policy holders. The new requirement becomes effective July 1, 2024.     HB 63


CYBERSECURITY

Nebraska enacted the Data Privacy Act. This law impacts how companies collect, process, and protect personal information.     LB 1074


DENTAL INSURANCE

Florida approved a bill amending its statutes on the payment of dental claims.     SB 892


DISCRIMINATION

South Carolina passed a law prohibiting insurers writing individual and group life, disability income and long-term care policies from discriminating against living organ donors.     HB 3255


DRUG / PRESCRIPTION COVERAGE

Maryland issued a bulletin reminding insurers of the requirements associated with prescription drug utilization review.     Bulletin 24-13


ELECTRONIC TRANSACTIONS

Oklahoma passed a bill permitting a health benefit plan sponsor to consent to electronic communication on behalf of covered individuals enrolled in the plan if certain actions are taken.     HB 3304

Tennessee passed a law requiring a hospital, physician, or other healthcare provider to accept an electronic insurance card as proof of an individual's health insurance plan or policy. The card must contain specific information. This act takes effect January 1, 2026.     HB 1877

West Virginia's Insurance Commissioner issued a new bulletin explaining the changes between the 2019 and 2023 laws regarding electronic prior authorizations.     Bulletin 24-03


FILINGS: HEALTH

Maine issued a bulletin notifying companies that it has created uniform deadlines for rate and form filings for non-grandfathered individual and small group Health Plans. The uniform rate and form filing deadline will be June 10, 2024.     Bulletin 474


FRAUD / ANTI-FRAUD

Alabama adopted amendments to its insurance fraud law, including increasing the statute of limitations from two years to seven. It also gives insurance fraud investigators the powers vested in law enforcement officers including the power of arrest and service of process.     HB 140

California's Special Investigative Unit issued a notification of changes to its SIU Annual Reporting Process. The new due date is September 15 with notification to be mailed during the last two weeks of June.     SIU E-Blast 2024-11


GUARANTY ASSOCIATION

Kansas enacted legislation related to the Kansas Insurance Guaranty Association Act. The bill makes numerous changes to the existing act, including updating certain definitions and establishing continuity of guaranty fund coverage when a policy is transferred from one insurer to another.     HB 2787


HEALTH CARE EXCHANGE / MARKETPLACE

Federal Centers for Medicare and Medicaid Services (CMS) issued a timeline for calendar year 2024 for Qualified Health Plan (QHP) data submission, rate review, form review and risk adjustment.     CMS Notice dated May 8, 2024

North Carolina's Insurance Department issued important filing information for carriers who will submit 2025 Plan Year exchange certified stand-alone dental (SADP) forms and rates to the North Carolina Insurance Department for review and approval.     Memo dated April 26, 2024


HOLDING COMPANIES

New Jersey's Insurance Holding Company System law was revised to mirror amendments to the NAIC model regulation.     NJAC 11:1-35.13


LONG-TERM CARE INSURANCE

California published a bulletin to all companies writing long-term care in the state, notifying them of the annual assessment to offset the costs of principle-based reserving (PBR). Assessments are applied on the gross annual long-term care premium written the previous year and applied on a tiered basis.     Bulletin 2024 - 2


MEDICARE SUPPLEMENT INSURANCE

South Dakota updated the Medicare Supplement rules for plans A through N and Appendix D to incorporate 2024 Medicare Supplement coverage amounts.     Regulation 20:06:13


MISCELLANEOUS

Nebraska revised its Deposit of Securities law that covers definitions, depositories, registered securities, and withdrawal.     Regulation 210 NAC Ch. 6 s 001

Oklahoma passed a bill which outlines the procedure for a mutual insurer to become a converted stock insurer and a mutual holding company or an intermediate stock holding company.   HB 3090


MISCELLANEOUS HEALTH / ACCIDENT

Arizona approved a bill allowing a health insurer to establish a savings incentive program for insureds who utilize a health care provider at a price below the insurers usual reimbursement amount.     SB 1402

Colorado enacted legislation addressing limitations on provider-administered drugs and setting standards for required coverage.     HB 1010

The Federal Departments of Labor, Health and Human Services (HHS) and the Treasury along with the Office of Personnel Management (OPM) issued FAQs regarding the No Surprises Act.     CMS Notice dated May 1, 2024

Iowa published a bulletin providing general information about Short Term Limited Duration Plans and announcing changes in the federal law limiting the maximum allowable coverage period.     Bulletin 24-01

Maine published a bulletin summarizing legislative changes affecting health insurance.  Bulletin 475

New Jersey's Department of Banking and Insurance issued a bulletin to all health insurance companies, health or dental service corporations and health maintenance or dental plan organizations informing them that consumers who lost Medicare or Children's Health Insurance Program (CHIP) coverage are eligible for a special enrollment period with these organizations. It also revised the guaranteed issue period for Medicare Supplement plans for individuals losing Medicaid coverage.     Bulletin 24-05

North Carolina's Department of Insurance provided guidance to insurers regarding the submission of Student Health insurance plans for the 2024/2025 School Year.     Memo dated April 26. 2024

Oklahoma amended its law dealing with credentialing and recredentialing of health care providers. If an application for credentialing or recredentialing is denied, the plan shall notify the applicant in writing the reason for the denial and what corrective actions the applicant may consider within ten (10) calendar days of the determination to deny the application.     SB 1631

Vermont passed a law requiring insurers to provide coverage for diagnostic breast imaging services without cost-sharing except under a high deductible health plan.     HB 621

OMNIBUS LEGISLATION

Kansas enacted legislation containing numerous provisions relating to insurance, including provisions for compensation to the insurance department when certain examinations are performed. The legislation sets and adjusts the maximum amounts that will be charged for consulting, data processing and other costs of the examination.     SB 356


PHARMACY BENEFIT MANAGERS

Oklahoma amended its Pharmacy Audit Integrity Act to modify audit provisions.     SB 1670


PREMIUM TAX

Kentucky published a bulletin outlining current policies and procedures relating to local government premium taxes.     Bulletin 2024-03

ADJUSTERS

Oregon adopted new rules to regulate the licensing, qualifications, and ethical conduct of public adjusters, excluding those handling auto insurance claims. The rules detail licensing procedures, continuing education, contract and fee requirements, standards of conduct, and mandatory recordkeeping.     OAR 836-071-1100 +


ADVERTISING / SALES & MARKETING

Oregon enacted legislation effective January 1, 2026, expanding the definition of telephone solicitations and auto-dialers to include text messages, and restricting solicitations to between 8 a.m. and 8 p.m., no more than three times in 24 hours. The law also clarifies exemptions for established business relationships and certain entities.     HB 3865


AGENT / PRODUCER LICENSING AND APPOINTMENT

Delaware requires all non-resident licensees to renew their licenses by February 28, 2027, with renewals accepted starting December 1, 2026, and fees paid online via NIPR. Renewal fees vary by license type, and continuing education is mandatory for certain adjusters, with reduced requirements for long-term licensees or those holding professional designations.     Notice of Non-Resident License Renewal 2027


AUTOMOBILE INSURANCE

Colorado amended its rules governing disclosure requirements for private passenger automobile insurance policies. The changes allow insurers flexibility in formatting the required summary document and adding new disclosures to Appendix C.     3 CCR 702 Reg. 5-2-16

Massachusetts requires motor vehicle insurers to file annual information returns reporting payments to repair shops, starting with payments made on or after January 1, 2025, with returns due to the Commissioner of Revenue by March 31 annually. Insurers must also provide copies to the repair shops by January 31.  This requirement is effective August 1, 2025.     830 CMR 62C.8.2

New Jersey is implementing phased increases to auto insurance minimum coverage limits under P.L.2022, c.87, with higher limits effective January 1, 2026. The Department of Banking and Insurance requires insurers to update rates, policy forms, and notify policyholders of new minimums by specified deadlines, exempting them from obtaining signed coverage selection forms for these increases. These changes apply to admitted and surplus lines insurers, self-insureds, and risk retention groups but exclude the basic auto policy under N.J.S.A. 39:6A3.1.     Bulletin 25-06

North Carolina announced updates to the Personal Auto Manual, effective October 1, 2025, including revised inexperienced operator surcharge factors, new classification codes, and editorial changes to Rule 5 of the Safe Driver Insurance Plan.     Circular Letter A-24-5


CANCELLATION / NON-RENEWAL / PREMIUM OR COVERAGE

Louisiana issued a notice requiring property and casualty insurers issuing homeowners or private passenger auto policies to disclose the prior policy premium on renewal notices, with full compliance due by January 1, 2026.     Advisory Letter 2025-03

Texas passed legislation effective January 1, 2026, clarifying that insurers are to provide written reasons for the declination, cancellation, or non-renewal of insurance policies. Insurers will be required to submit quarterly reports to the Department of Insurance summarizing such actions by ZIP code (except for workers’ comp which is reported statewide and not by zip codes).     HB 2067


CAPTIVES

Connecticut announced expanded flexibility for captive insurers with the signing of Public Act No. 25-130. The legislation allows various captive types to convert into protected cells and enables sponsored captives to transfer cells and their assets, subject to DOI approval.     Notice Dated 7/25/25


CLAIMS / CLAIMS ISSUES

North Carolina issued a bulletin directing insurers to adopt safeguards when using aerial imagery in underwriting and claims handling. The Department raised concerns about inaccurate or outdated images leading to improper non-renewals, and now requires insurers to use recent, reliable imagery, disclose reasons and evidence to policyholders, and allow disputes before action is taken.     Bulletin 25-B-09


COMMERCIAL LINES INSURANCE

Michigan published the updated list of municipalities participating in the Fire Insurance Withholding Program, effective September 1, 2025. The program allows certain municipalities to escrow 25% of fire insurance settlements for covered property losses, with participation and coverage varying based on population thresholds. Insurers must receive at least 30 days’ notice before new municipalities apply the program.     Notice Dated 8/1/25


CREDIT INSURANCE

Arizona issued an order establishing updated prima facie rates for credit property insurance effective February 1, 2026, while maintaining the 51.5% loss ratio standard set in 2013. Insurers may file for higher deviated rates using the Credibility Table in Exhibit B, following A.R.S. § 20-1621.05. The Order also requires annual experience reports from insurers by April 1.     Order Dated 7/31/25


CYBERSECURITY

North Dakota updated its insurance data security and cybersecurity event reporting requirements under NDCC Chapter 26.1-02.2. All DOI licensees must maintain a written Information Security Program and report cybersecurity events impacting 250 or more consumers within three business days. HIPAA-covered entities may be exempt from some provisions but must still notify the DOI.     Bulletin 2025-1


DISASTER / CATASTROPHIC EVENT

California is now enforcing a mandatory one-year moratorium on cancellations and non-renewals of residential property insurance policies following the June 18, 2025, state of emergency declaration for the Franklin Fire in Malibu. The bulletin applies to all insurers covering properties in specified ZIP Codes and requires reinstatement or renewal offers for policies canceled due to wildfire risk since the declaration date.     Bulletin 2025-12


FILING REQUIREMENTS / PROCEDURES

Alabama consolidated several prior bulletins concerning the mandatory use of SERFF and providing filing fees.     Bulletin 2025-04

Virginia’s Bureau of Insurance updated its June 2025 Property and Casualty Filing and Product Guidelines to clarify Excess Workers’ Compensation filings, mandate offers of water backup and diminution of value coverage and provide new guidance on Workers’ Compensation credits and rating plans.     SCC Notice Dated 7/9/25


GUARANTY ASSOCIATION

New Jersey has authorized insurers to impose a surcharge of up to 0.3% of net direct written premiums on applicable policies issued or renewed on or after October 1, 2025, to recoup the PLIGA assessment due September 15, 2025. This applies to most lines of insurance except life, health, workers' comp, title, and other excluded lines. Insurers must stop surcharges once the assessment is fully recouped and properly account for any excess funds.     Order A25-02


MISCELLANEOUS

Louisiana adopted new regulations establishing an Insurance Regulatory Sandbox Program to allow insurers to test innovative products and services with temporary waivers from certain laws. The regulation sets application, reporting, and disclosure requirements, limits participation, and includes provisions for waiver denial, revocation, and confidentiality.     LAC 37 XIII.20501


PERSONAL LINES INSURANCE

New York enacted the Third Amendment to Insurance Regulation 159 to standardize hurricane deductibles for homeowners' and dwelling fire policies. The regulation clarifies when deductibles apply, mandates prominent disclosures in policy documents, and limits deductibles to wind losses occurring around a hurricane’s landfall in New York. It also sets new definitions, notice requirements, and minimum standards for applying hurricane deductibles based on proximity to the coastline or by county.     11 NYCRR 74.0


PREMIUM ISSUES

Delaware issued guidance clarifying that property and casualty insurers must include operating expenses in filed rates and policy premiums, prohibiting separate fees such as policy, inspection, or administrative charges. The bulletin permits only certain fees—like installment or late payment fees—if they are actuarially justified and meet specific conditions.     Forms and Rates Bulletin 41


REGULATORY REPORTING REQUIREMENTS

New Hampshire mandates insurance companies to notify the Insurance Department before discontinuing certain lines of business. Fire and casualty insurers must provide 120 days’ notice to the department and agents before ceasing a line.     SB 121


REPORTS - DATA CALLS & OTHER REPORTS

Florida issued a memorandum requiring authorized personal and commercial residential property insurers to annually submit detailed claims data by March 1, 2026, under Rule 69O-171.011, F.A.C. Insurers must provide comprehensive information on closed claims to help monitor litigation and claims trends and ensure consumer protection.     Informational Memorandum OIR-B1-2222


SURPLUS LINES

Alaska updated its list of eligible surplus lines insurers, introducing revised classifications and clarifying eligibility under the NRRA. The bulletin distinguishes between “White Listed” foreign insurers and “Listing Approved” alien insurers, while removing alien insurers from the traditional white list.     Bulletin B 25-06

Illinois amended its Insurance Code to revise the definition of "home state" for surplus line insurance under 215 ILCS 5/445. For groups of non-affiliated insureds on a single contract, "home state" is now determined by the principal place of business or residence of an insured, or, if all insured risk lies outside that state, by the state receiving the largest share of taxable premium for the contract.     SB 1289

Puerto Rico issued a Circular Letter notifying surplus lines insurance brokers of the official name change of Discover Specialty Insurance Company to Travelers Specialty Insurance Company.     Circular Letter CC-2025-2046-AF


WORKERS' COMPENSATION

Arizona announced the launch of a revised Notice of Claims Status (Form 104). The updated form includes new claimant identification fields, expanded work status options, and stricter submission requirements, with mandatory use beginning October 21, 2025. The ICA encourages electronic submissions and requires prior approval for any form modifications.     Notice Dated 7/28/25

Connecticut announced the publication of the 2025 Official Practitioner Fee Schedule for all medical services rendered on or after that date under the Workers' Compensation Act. The updated schedule includes rule clarifications and incorporates the 2025 CPT codes.     Memorandum 2025-03

Delaware launched WorkComp360, a new cloud-native analytics platform from the Delaware Compensation Rating Bureau (DCRB). Designed for executives, underwriters, actuaries, and regulators, the platform replaces static reports with dynamic tools like injury visualizations and customizable benchmarking. Members can access WorkComp360 via www.dcrb.com.     DCRB Circular 1059

Illinois issued clarification that all workers’ compensation rate filings, including “consent to rate” policies for high-risk or unusual businesses, must be filed for approval at least 30 days before use, per Article XXIX and Public Act 100-11181. The bulletin emphasizes that rates cannot be excessive or unfairly discriminatory, and premium increases over 5% require advance notice.     Company Bulletin 2025-15

Indiana’s Compensation Rating Bureau adopted updates to the NCCI Basic Manual for Workers Compensation and Employers Liability Insurance to revise classifications for hazardous material remediation services involving asbestos, mold, and lead paint, and to clarify classification of construction employees performing janitorial-type work under Code 5059.     Circular 2025-07

Minnesota’s Workers' Compensation Insurers Association (MWCIA) announced updates to the NCCI Medical and Indemnity Data Call reporting requirements for workers' compensation insurers. Changes to the Medical Data Call began with Q4 2024 data (due Q1 2025), while new elements for the Indemnity Data Call apply starting with Q4 2025 data (due Q1 2026).     WC Circular Letter 25-1861

Nevada’s Division of Industrial Relations, Workers’ Compensation Section, requires all workers’ compensation insurers, including private carriers and self-insured employers, to submit the Fiscal Year 2025 Claims Activity Report or a Statement of Inactivity via the CARDS portal by September 1, 2025. The report must consolidate data from all TPAs, cover the period July 1, 2024, to June 30, 2025.     Notice Dated 7/15/25

AGENT / PRODUCER LICENSING AND APPOINTMENT

Louisiana's Insurance Department updated its producer and adjuster license renewal procedures, fees, filing methods, and standards of conduct, effective January 2026. Key changes include renewal schedules based on license number, updated fees with late penalties, options to file renewals via the Industry Access Portal or NIPR, continuing education compliance requirements, and acknowledgment of claims adjuster standards of conduct. Non-renewed lines may be reactivated within two years with continuing education, or after two years by meeting exam requirements.     Notice Dated 11/28/25


AUTOMOBILE INSURANCE

Colorado released guidance on submitting the interim progress report required under Regulation 10-1-1 for insurers using external consumer data or models to write Private Passenger Auto. Insurers may choose their own format but are encouraged to include an executive summary, progress updates, challenges, solutions, and expected completion dates.     Bulletin B-10.005

Nevada has revised its code to permit short-term vehicle lessors to request, and no longer require, proof of certain insurance as a condition for leasing a passenger car.     SB 1


CAPTIVES

Arizona amended its regulations to add new fees and defined processing timeframes for captive insurers seeking a Certificate of Dormancy, effective January 4, 2026. The updates introduce specific dormancy application, renewal, and surrender fees, clarify examination cost obligations, and establish a 60-day total licensing timeframe for dormancy-related filings.     R20-6-708 Table A


DISASTER / CATASTROPHIC EVENT

California's Governor issued an order expanding and clarifying prior wildfire-related directives to speed rebuilding after the fires in Los Angeles and Ventura Counties, including suspending certain 2025 building code requirements to reduce reconstruction costs while preserving insurance eligibility for code-upgrade coverage.     Executive Order N-37-25


FILING REQUIREMENTS / PROCEDURES

District of Columbia released filing compliance checklists for 2024 and 2025 for life, accident and health; property and casualty; health entities; and title companies. The guidance clarifies that companies not offering or writing medical stop-loss coverage are exempt from filing the DC Stop Loss Reporting Form, and that the instructions do not apply to DC captive insurers.     Notice Dated 11/8/25


FILINGS: PROPERTY / CASUALTY

Hawaii announced the reorganization of the Rate and Policy Analysis Branch into two specialized units: the Life and Accident & Health Filings Branch and the Property and Casualty Filings Branch. This restructuring aims to improve review timeliness and regulatory oversight.     Memorandum 2025-12R

Hawaii's Insurance Department extended the comment period for revised Property and Casualty rate filing procedures, initially issued in Memorandum 2025-10R, to December 31, 2025. The updated General Requirements and Filing Instructions modernize the P&C rate filing process, with compliance required by February 1, 2026, though insurers may begin using the new forms immediately.     Memorandum 2025-11R

Louisiana announced the availability of the Confidentiality Affidavit referenced in Advisory Letter 2025-04, allowing insurers to designate rate filing documents as confidential, proprietary, or trade secret. Submitted affidavits will be reviewed by the LDI, and if approved, an attestation will be issued for inclusion in the filing.     Bulletin 2025-06

Nevada's Insurance Department has established a Flex-Rated Filing Program for property insurance on real property, effective January 1, 2026. Insurers may use this program as an alternative to standard rate filings under NRS 686B.070 by filing through SERFF and indicating participation.     Bulletin 25-005


HOLDING COMPANIES

Mississippi has amended its insurance holding company regulations to align with the NAIC Model. Changes revise minimum requirements for cost-sharing and management service agreements, establish provisions for group capital calculations, including exemptions and limited filings for qualifying systems, and renumber and update sections on Adequacy of Surplus. All new and renewal reinsurance transactions from July 1, 2017, forward must comply with these requirements.     Regulation 19-1-20.19

Oregon amended OAR Chapter 836 to update definitions, expand prior notice requirements for transactions involving cost-sharing and management services, and establish rules for annual group capital calculations for insurance holding company systems. The amendments clarify ownership and control of books, records, and data, and specify affiliate obligations during supervision or receivership. The regulation also sets standards for non-U.S. jurisdictions that “recognize and accept” the group capital calculation.     OAR 836-027-0005 +


LIABILITY INSURANCE

District of Columbia has adopted the Rental Amendment Act of 2025 to revise tenant and housing provider protections. Revisions include expedited court review for evictions related to dangerous crimes, discretionary dismissal of claims based on equities, and a reduction of the pre-filing notice period for nonpayment evictions from 30 to 10 days. The Act also updates procedures for delivering pre-filing notice.  A lessee is required to maintain personal injury and property damage liability insurance on the property that names the owner as the additional insured.     B 164


MISCELLANEOUS

Michigan's Insurance Department published an updated list of municipalities participating in the Fire Insurance Withholding Program, effective January 1, 2026. The list specifies the program section for each municipality and supersedes prior editions, with changes accepted in writing from participating municipalities.     Notice Dated 12/1/25

New Mexico issued an amended bulletin, replacing Bulletin 2021-014, to provide the correct “Notification of Intent to Offer Value-Added Products and Services Filing Instructions and Form.” The bulletin clarifies regulations under Section 59A-16-17 NMSA 1978 regarding permissible value-added offerings while maintaining prohibitions on inducements in insurance contracts.     Bulletin 2025-006


PERSONAL LINES INSURANCE

North Carolina’s Rate Bureau announced the availability of materials for the 2027 Homeowners Policy Program, which will replace the current program for policies effective June 1, 2027. The bulletin also corrects a prior circular letter by including Form HO 06 43 03 22 Cosmetic Damage Exclusion-Windstorm or Hail, which had been omitted.     Circular Letter P-25-4


PHARMACY BENEFIT MANAGERS

Alaska issued a bulletin to guide implementation of SB 132, which overhauls licensing and regulatory requirements for PBMs, TPAs, Independent Adjusters, and other entities effective January 1, 2026. The bulletin outlines new fees, expanded licensing obligations, updated definitions, national-standard uniformity changes, and revised compliance officer rules. Illinois updated its insurance code to expand preventive health and vaccine coverage, strengthen PBM contract, reporting, and licensure requirements, clarify unfair insurance practices, revise pharmacy practice definitions, and establish a pharmacy support grant program to improve access in underserved areas. The amendments include detailed provisions on coverage without cost-sharing, PBM pricing and drug access restrictions, reporting and refund obligations, and annual reporting on pharmacy grant distribution.     HB 767

Kentucky has amended its insurance code to enhance PBM licensure, renewal, and oversight requirements. Specific changes include a $10,000 registration fee (with workers’ compensation–only PBMs exempt), clarified renewal procedures and deadlines, a $500 late renewal penalty, and a $1,000,000 minimum financial responsibility requirement via insurance or surety bond. PROPERTY INSURANCE

Delaware reminds carriers of their obligations to accurately report geographic premium allocations and fire department payments, citing ongoing concerns about inconsistent filings. REPORTS - ANNUAL / QUARTERLY STATEMENT

Kansas issued NAIC instructions and calculations effective for calendar year 2026, including risk-based capital (RBC) instructions, the Financial Analysis Handbook, group capital calculation instructions, and the NAIC liquidity stress test framework. These requirements apply to filings as of December 31, 2025, for annual, quarterly, and group capital reports, as well as liquidity stress test submissions.     Notice of NAIC Instructions 2026


REPORTS - DATA CALLS & OTHER REPORTS

Louisiana released a bulletin requiring all admitted commercial and private passenger auto insurers to submit data covering 2015–2024 via the NAIC Reporting Portal. Certain specialty insurers are excluded, and submitted data is treated as confidential.     Bulletin 2025-08

Louisiana requires that the Annual Premium Tax Statement (Form 1061) and Annual Municipal Premium and Tax Report (Form 1076) be filed online through the Industry Access Portal. Companies claiming investment or military tax credits must also submit Forms 1068C and 1425, respectively, along with supporting documents.     Notice Dated 11/14/25


SURPLUS LINES

California's Department of Insurance updated the 2025 Export List to add Commercial Cannabis Related Operations and revise Foster Family liability categories, identifying coverages that may be placed with non-admitted insurers without meeting most section 1763 requirements. The bulletin reiterates that non-listed risks may still be exportable with proper diligent search documentation and outlines the range of coverages included on the updated list.     Bulletin 2025-16

Montana published an updated list of surplus lines companies eligible in the state, including each company’s name, NAIC code, and state of domicile. Surplus lines producers may also place insurance with alien companies listed on the NAIC’s “Quarterly Listing of Alien Insurers,” per MCA 33-2-307(3).     Notice Dated 11/19/25

New Jersey's Insurance Department issued updated lists of eligible foreign and domestic surplus lines insurers, as well as eligible alien surplus lines insurers per the NAIC Quarterly Listing of Alien Insurers, reflecting additions, deletions, name changes, and redomiciled companies.     Notice Dated 11/13/25


WORKERS' COMPENSATION

California's Division of Workers’ Compensation announced updated 2026 temporary total disability rates, with the minimum increasing to $264.61 and the maximum to $1,764.11 per week. These SAWW-based adjustments also apply to life pension and permanent total disability benefits for eligible workers.     DWC Release 2025-116

Florida's Insurance Department announced that the maximum weekly workers’ compensation rate for injuries occurring on or after January 1, 2026, will be $1,358, based on a statewide average weekly wage of $1,357.95 for the year ending June 30, 2025. Idaho's Industrial Commission published the 2026 Workers’ Compensation Benefits table, establishing an Annual Average Statewide Wage of $1,135 and providing compensation rates as percentages of the Average Weekly Wage. Minnesota published the 2025 State of the Market Report, which analyzes Minnesota’s workers’ compensation market. The report notes a 2% decline in premium volume in 2024, a nearly 10% increase in average indemnity costs per claim, and stable net case reserves due to ongoing reserve releases.     WC Circular Letter 25-1869

Missouri announced the 2026 workers’ compensation rates following NCCI’s proposed 1.3% increase in loss costs, the second rise in six years due to historically low workplace injury frequency. Industry-specific changes include Manufacturing (+2.9%), Contracting (+0.3%), Office & Clerical (+2.1%), Goods & Services (+0.4%), and Miscellaneous (+1.8%).     Notice Dated 11/18/25

Nebraska announced that, effective January 1, 2026, the maximum weekly income benefit for work-related injuries and illnesses will increase to $1,166, while the minimum remains $49. Benefits are calculated at 100% of the state average weekly wage, rounded up.     WC Notice Dated 11/18/25

Nevada released guidance addressing SB 317, which updates the workers' compensation system. The guidance addresses topics including physical office requirements, self-insured employer claims administration, maximum employee benefit calculations, temporary partial disability payments, subsequent injury accounts, administrative fines, delegation of care to physician assistants, drug formulary updates, mental health provider lists, and related claims administration requirements.     Notice dated November 12, 2025

New Jersey announced 2026 workers’ compensation benefit rates, effective January 1, 2026. Maximum benefits for Temporary Disability, Permanent Partial Disability, Total Disability, and Death Benefits are $1,199, with minimums of $320 for Temporary and Total Disability and $35 for Permanent Partial Disability; Temporary and Total Disability benefits are calculated at 70% of wages, while Permanent Partial Disability varies by injury type and severity.     LWD Notice Dated 11/25/25

North Carolina approved filing WC2025-04 from the North Carolina Rate Bureau, revising the Basic Manual for Workers' Compensation and Employers’ Liability. Producer fees for minimum premium policies are now based on the full minimum premium including the expense constant, and premium-financed residual market policies must pay 100% of the estimated annual premium upfront. United States CMS issued an alert maintaining recovery thresholds of $750 for physical trauma-based liability insurance, no-fault insurance, and workers’ compensation settlements where the payer has no ongoing medical responsibility, while clarifying that the threshold does not apply to ingestion, implantation, or exposure claims.     CMS Notice Dated 11/18/25 (3)

ARTIFICIAL INTELLIGENCE

District of Columbia published a bulletin reminding all carriers doing business in the District of the department's expectations regarding the use of artificial intelligence.     Bulletin 24-IB-002-05/21


CONFIDENTIALITY / PRIVACY

Federal Department of Health & Human Services updated its Change Healthcare Cybersecurity Incident Frequently Asked Questions. CYBERSECURITY

Oklahoma created an Insurance Data Security Law. It requires licensees to develop a data security program, conduct a risk assessment, and send notifications when a breach occurs. Annually by April 15, each insurer domiciled in this state is required to submit to the Commissioner a written statement certifying that the insurer complies with the requirements set forth in this law.     SB 543

Pennsylvania amended its Breach of Personal Information Notification Act to require that notice of a security breach be given to the attorney general when there are more than 500 affected persons in the Commonwealth.     SB 824


DENTAL INSURANCE

Rhode Island passed the Dental Insurance Loss Ratio Reporting and Study Act. Dental insurers are required to file an actuarial memorandum disclosing incurred claims and earned premiums for reporting years 2023, 2024 and 2025. The Commissioner will use the information to recommend a dental insurance loss ratio.     HB 7944

Colorado enacted legislation concerning health insurance carrier price transparency requirements.     SB 80


DISCRIMINATION

Maine published a bulletin clarifying that health insurers are to cover fertility care without discrimination. The bulletin states that carriers may not discriminate against any class of insureds protected by the Maine Human Rights Act and carriers shall make coverage available regardless of sexual orientation, gender identity or expression or family composition, including single parents.     Bulletin 476

New Hampshire amended its Unfair Insurance Trade Practices law to prohibit an insurer selling life, long term care or disability insurance from discriminating against living organ donors.     HB 1155


EXCEPTED BENEFITS

Virginia's Insurance Bureau published new guidance concerning Wellness Benefits in Excepted Benefits Policies. Carriers are advised to review and amend policy forms and rates.     Notice dated May 28, 2024


FILINGS: HEALTH

Alabama published a bulletin notifying companies of updated filing requirements for Short-Term, Limited Duration Insurance (STLDI) and other excepted benefit coverage. The new bulletin replaces Bulletin 2018-04. The bulletin states that effective immediately previously filed STLDI, Hospital Indemnity, or other fixed indemnity insurance policies must be resubmitted for rates and forms review and approval.     Bulletin 2024-02

GUARANTY ASSOCIATION

Iowa published a bulletin providing an updated summary document for the Iowa Life and Health Guaranty Association. The document is updated to reflect the new address for the Guaranty Association.     Bulletin 24-02


HEALTH INSURANCE - COMPREHENSIVE

Illinois adopted a regulation clarifying the requirements for coverage of over-the-counter contraceptive drugs.  Companies may not require that an insured have a prescription for over-the-counter contraceptives as a condition for coverage to apply.     50 Ill Adm Code 2014

New Hampshire amended its Women's Health Care law to prohibit insurers providing coverage for diagnostic and supplemental breast examinations from applying cost-sharing, co-pays or other cost sharing requirements.     HB 1296


MARKET CONDUCT

California published a bulletin notifying all domestic insurers of the provisions of Sec 706.7 of the California Insurance Code and specifying those states which will be given "reciprocal" status. Insurance Commissioners in those jurisdictions are asked to notify California of violations by domestic insurers.     Bulletin 2024-4


MENTAL HEALTH PARITY

Maine published a bulletin clarifying the provisions of its "Act To Provide Greater Access to Treatment for Serious Mental Illness by Restricting Prescription Drug Utilization Management by an Insurance Carrier."     Bulletin 478

MISCELLANEOUS HEALTH / ACCIDENT

Federal Internal Revenue Service announced the 2025 adjustments for Health Saving Accounts (HSA) and High Deductible Health Plans (HDHP). The self-only annual contribution limit for a HAS increased to $4,300 from $4,150 in 2024. The self-only HDHP minimum deductible increased to $1,650 from $1,600 in 2024.
